CAN-SPAM Act from the Federal Trade Commission
Commercial emailing is defined by the Federal Trade Commission as any electronic message that has the primary purpose of advertisement or promotion of a product or service. There are no exceptions to this law which means all emails must comply with the law. Each violation of the CAN-SPAM Act is subject to penalties up to $16,000 per email. The law also states that even if you hire AOM Services to handle your email marketing, you cannot contract away your legal responsibility to comply with the law.
We take the CAN-SPAM Act very seriously and adhere to every detail of the law. As a result, we have never had an issue with the Federal Trade Commission and our clients as well as our own business leaders are quite intent on keeping it this way.
All emails sent by AOM Services will be subject to revisions and modifications to make sure the message adheres to the CAN-SPAM Act. Messages that are revised will first be sent to your business for review and upon approval they will be sent to the email recipients.
Viable Businesses Only
The opt-in list has a two stage process. The first part asks the individual if they would like to sign up to receive promotional offers from AOM Services, our partners and affiliates. The second portion of the process is an email that is then sent to the individual which has a click to verify they signed up to receive promotional offers from AOM Services, our partners and affiliates.
Because the terms are very clear during the sign up process, we only extend emailing to our promotional database to viable businesses. We do not allow spam messages, malware, threatening, harmful or otherwise unwanted messages to be sent to our database.
If you are providing your own database to email to, then the only restrictions will be to ensure your message complies with the CAN-SPAM Act.
Email Messages and Templates
Carefully crafting email messages can help to improve open rates and click-through rates. An open rate is the percent of people who open the email. A click-through rate is the percent of people who open an email then click through to your website or offer.
It is our goal to continually improve open rates and click-through rates. This is why we use advanced email technology in our templates that will display your business name as the sender, compress images within an email using CSS techniques and allow for a message to be opened that displays all graphics.
Often when you receive a message from an unknown sender, these messages ask the user to “Click to Download Images” before the content is able to be viewed correctly. With over 50% of the email messages we send out, the messages are received as they were intended to be viewed by the sender without requiring the user to “Click to Download Images.” This technique greatly increases click-through rates which translate into increased traffic, sales and revenue for your website.
Depending on your budget and market, you can choose to use our opt-in database to send emails or you can provide AOM Services your own email list. If you provide AOM Services with your own list, your database will remain strictly confidential as we will provide a non-compete that states we will not directly or indirectly solicit business from or attempt to sell, license or provide the same or similar services to, with or from your database.
Often the best email marketing campaigns have advanced filters. These campaigns are commonly referred to as “Drip Campaigns” which allows businesses to set triggers based on timelines, actions or timelines and actions.
Example of a drip campaign based on an action: A business selling shoes sends out an introduction email with a variety of different shoes. Out of the 10 different shoes in the email, a user clicks on golf shoes. Later this same user receives an email with only different varieties of golf shoes offered by the business.
Example of a drip campaign based on a timeline: A business sends out an email on the 1st of the month letting their customers know they have a promotion for 25% off all orders until the 15th of the month. On the 8th, the 13th and the 15th additional promotional email reminders are sent out to the database to increase last minute sales.
Example of a drip campaign based on timeline & action: A business is having an inventory blowout sale at the end of the month and is emailing their customers as well as a prospect list from AOM Service’s database. All users are then emailed every week of the month to be reminded of the sale. Users who open the email and click on any of the links are then sent a follow up email with a special 10% off coupon to be used with their purchase at the inventory blowout sale. The coupon email is only sent out once and everyone in the list continues to receive the weekly emails until the sale has finished.
